$5.1 Million in Settlements for 42 Year Old Woman with Second-Hand Exposure.
A jury in the Circuit Court of the 22nd Judicial Circuit of Missouri (City of St. Louis) on Friday awarded a $5.1 million dollar verdict in favor of a St. Clair County, Missouri family for the death of a 42-year-old woman who died of mesothelioma, a cancerous tumor caused by exposure to asbestos. The woman was exposed during her childhood when her father brought asbestos dust home on his clothing from work he had done for Aerojet.
At the beginning of the trial, Judge Robert H. Dierker concluded Aerojet intentionally failed to comply with discovery rules by falsely denying any involvement with asbestos or asbestos components. As a result the Court imposed sanctions against Aerojet and ultimately directed the jury to find as a fact the decedent was exposed to asbestos from Aerojet materials machined by her father.
Because Aerojet also refused to produce information concerning its knowledge of the hazards of asbestos and its involvement with asbestos products, the Court also directed the jury to find Aerojet had actual knowledge of what the industry knew concerning the hazards of asbestos at the time the father worked with their products.
